1. Acceptance of These Terms
Numeral Paint operates NumeralPaint.com and the related online store. In these Terms, “Numeral Paint”, “we”, “us” and “our” refer to the business operating the Site.
By accessing the Site or placing an order, you agree to these Terms and the policies linked from them. If you do not agree, do not use the Site or purchase products.
2. Eligibility and Acceptable Use
You must be legally capable of entering a purchase agreement in your location or use the Site with the permission of a parent or legal guardian.
You must not use the Site to:
- Break applicable law or infringe another person’s rights.
- Transmit malware, interfere with security or disrupt the Site.
- Scrape, copy or exploit Site content without permission.
- Submit false, fraudulent or misleading information.
- Harass staff, customers or other users.
3. Product Information and Orders
We aim to describe products, options, colours and included components accurately. Screen settings, lighting, paint batches and manufacturing tolerances can cause reasonable variation.
Submitting an order is an offer to purchase. We may decline, limit or cancel an order for reasons including suspected fraud, pricing errors, stock limitations, delivery restrictions or misuse of a promotion. If payment has already been captured for a cancelled order, the appropriate amount will be returned to the original payment method.
4. Custom and Personalised Products
You confirm that you have permission to upload and use every photo, logo, artwork or other material submitted for a custom product.
Custom images are reviewed before production, but the final result depends heavily on the quality, lighting, composition and resolution of the submitted file. We may request a replacement image when the original is unsuitable.
Personalised products are made specifically for the customer and normally cannot be returned merely because the customer changed their mind. Rights relating to damaged, incorrect or defective goods remain subject to the Returns & Refunds Policy and applicable law.
5. Prices, Currency and Payment
Prices, promotions and product availability may change without notice. The price and currency displayed in the final checkout summary govern the transaction, except where an obvious error occurred.
Payment is processed by third-party payment providers. You authorise the selected provider to charge the amount shown at checkout and confirm that the billing information supplied is accurate.
6. Processing, Shipping and Delivery
Processing and transit estimates are not guaranteed delivery dates. Custom products require preparation before dispatch. International orders can be delayed by customs, carrier inspections, weather, public holidays or local delivery conditions.
Customers are responsible for providing a complete and accurate address. Contact support immediately when an address correction is needed. Once an order has been processed or shipped, changes may not be possible.
Multi-item orders may be delivered in separate parcels.
7. Changes, Cancellations, Returns and Replacements
Contact us as soon as possible to request a change or cancellation. We cannot guarantee changes after production or fulfilment has started.
Returns, exclusions, damaged-item claims, replacements and refunds are governed by the Returns & Refunds Policy, which forms part of these Terms.
8. Intellectual Property
Unless otherwise stated, the Site’s text, layout, original graphics, branding and other protected content are owned by or licensed to Numeral Paint. You may use the Site for personal shopping and informational purposes but may not reproduce, sell or commercially exploit protected content without permission.
Suspected infringement can be reported through the Intellectual Property Claim procedure.
9. Reviews, Photos and Other User Content
When you voluntarily submit a review, testimonial, finished-painting photo or other content for publication, you confirm that you have the necessary rights and that the content is accurate and lawful.
Unless a separate agreement says otherwise, you grant Numeral Paint a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize and display the submitted content for operating and promoting the business. You may ask us to stop future use, although archived or previously published materials may not disappear immediately.
10. Third-Party Services and Links
The Site may rely on payment, hosting, analytics, email, shipping, review and social-media services. Those providers operate under their own terms and privacy practices. We are not responsible for the content or availability of independent third-party websites.
11. Disclaimers and Limitation of Liability
To the maximum extent permitted by law, the Site and its content are provided on an “as available” basis. We do not guarantee uninterrupted access, error-free operation or that every product will meet subjective expectations.
Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. Subject to those mandatory protections, Numeral Paint is not liable for indirect, incidental or consequential loss arising from use of the Site or products.
12. Responsibility for Your Breach
To the extent permitted by law, you are responsible for losses, claims or costs caused by your unlawful use of the Site, infringement of third-party rights or material breach of these Terms.
13. Suspension and Termination
We may suspend or restrict access where reasonably necessary to protect the Site, investigate fraud, enforce these Terms or comply with law. Obligations that logically continue after termination remain effective.
14. Changes to the Site or These Terms
We may update products, prices, services and these Terms. The updated date at the top of this page shows when the current version was published. Continued use after an update constitutes acceptance where permitted by law.
15. Severability and No Waiver
If one provision is unenforceable, the remaining provisions continue to apply. Failure to enforce a right immediately does not waive that right.
16. Governing Law and Disputes
Insert the governing law, legal business name, registered address and dispute venue that apply to the entity operating Numeral Paint. Mandatory consumer protections in a customer’s location may still apply.
